Welcome to the Terms and Conditions page of Havornelix. This document explains how you can use our online shop, what happens when you place an order and what you can expect from us.

Introduction

These Terms govern the use of the Havornelix online shop and every purchase contract or other legal relationship between you and us. Capitalised words are explained in the Definitions section at the end of this document.

Please read this document carefully before placing an order.

Nothing in these Terms creates a relationship of employment, agency or partnership between you and us.

What You Should Know at a Glance

Some provisions in these Terms only apply to Consumers or only to Business Users. Wherever this is the case, it is clearly stated in the clause. If no such limitation is mentioned, the clause applies to all Users.

We ship to addresses in Germany only. Orders are sent from Germany or France.

Standard shipping is free and usually takes 4 to 5 business days. Insured Express Shipping costs 4.95 EUR and usually takes 2 to 3 business days.

As a Consumer, you have a 14 day right of withdrawal. The costs of returning goods are borne by you.

All products come with the statutory guarantee of conformity of two years from delivery. In addition, we offer a voluntary 15 day money back guarantee.

Unless stated otherwise, the terms in this section apply whenever you use our online shop.

By using Havornelix, you confirm that you meet the following requirements:

You may use our shop whether you are a Consumer or a Business User.

You are not located in a sanctioned territory designated by an authority that we are directly or indirectly subject to.

Content on Havornelix

Unless stated otherwise or clearly recognisable, all content in our online shop, including texts, product photos, graphics, the Havornelix name and logo, is owned by us or provided by our licensors.

We make every effort to ensure that the content in our shop does not infringe any legal provisions or the rights of third parties. If you believe that any content does, please let us know using the contact details in this document so we can look into it right away.

We hold and reserve all intellectual property rights in this content. You may not use it in any way that goes beyond what is necessary for the normal use of our shop.

In particular, you may not copy, download, share, modify, translate, publish, transmit, sell, sublicense or create derivative works from any content in our shop, nor allow anyone else to do so through you or your device.

Any statutory limitations or exceptions to copyright remain unaffected.

Links to External Websites

Our shop may contain links to websites or resources provided by third parties. We have no control over these resources and are therefore not responsible for their content or availability. The terms and conditions of the respective third party apply to their use.

Acceptable Use

Our shop may only be used for its intended purpose and in accordance with these Terms and applicable law. You are responsible for making sure that your use of our shop does not violate any law, regulation or third party rights.

We reserve the right to take appropriate measures to protect our legitimate interests, including denying access to our shop, terminating contracts or reporting misconduct to the competent authorities, if you violate laws, regulations or these Terms, infringe the rights of third parties, considerably impair our legitimate interests or offend us or any third party.

TERMS AND CONDITIONS OF SALE

Products

Havornelix sells women's clothing, accessories and lifestyle products. Prices, descriptions and availability are shown on the respective product pages.

We present our products as accurately as possible. Colours may look slightly different depending on your screen settings, and small variations in natural materials are normal. Size information is provided as a guide, and we recommend checking the size chart on each product page before ordering. The main characteristics of the product you choose are shown again during the checkout process.

Purchasing Process

Every step from choosing a product to submitting your order is part of the purchasing process. It works as follows:

You choose the products you would like and add them to your shopping cart.

At checkout, you enter your details, choose your shipping option and payment method and review your order. You can correct any of your entries before submitting your order.

You place your order by clicking the order button.

Order Submission

When you submit your order, the following applies:

Submitting your order concludes the purchase contract and creates the obligation for you to pay the price, including taxes and any shipping costs, as shown on the order page.

Right after you submit your order, you will receive an email confirming that we have received it, together with your order details and these Terms.

All notifications related to your order are sent to the email address you provided during checkout.

Our shop is written in English and is automatically translated into German for your convenience. The contract language is English. If there are any differences between the English version and the automatic German translation, the English version applies. We save the text of your order, and these Terms can be viewed and printed on our website at any time.

Prices

All prices in our shop are shown in euros and include the statutory value added tax. Before you submit your order, you are informed of all costs you will be charged, including any shipping costs.

Offers and Discounts

From time to time, we may offer discounts or special offers. Each offer is subject to the eligibility criteria and conditions stated in the relevant section of our shop.

Offers and discounts are granted at our sole discretion. A repeated or recurring offer does not create any right to receive the same offer in the future.

Depending on the offer, discounts may be valid for a limited time or while stocks last. Time limits refer to German time unless stated otherwise.

Discount Codes

Offers and discounts may be provided in the form of a discount code. If the conditions for using a discount code are not met, we may refuse to apply it.

Any specific rules shown on the discount code itself or on the related offer page always take priority. Unless stated otherwise, the following rules apply:

A discount code is only valid when used in the way and within the time period stated in the offer.

A discount code can only be applied in full at the time of purchase. Partial use is not possible.

Single use discount codes can only be used once.

Discount codes cannot be combined with each other.

Discount codes expire automatically at the end of their validity period and cannot be exchanged for cash.

If the value of your order is lower than the value of the discount code, the difference will not be refunded or credited.

Discount codes are for personal, non commercial use only. Reproducing, selling or trading discount codes is not permitted.

Methods of Payment

The accepted payment methods are shown during checkout. Payment is due when you place your order.

All payments are processed by independent third party payment providers. We do not collect or store your payment details, such as credit card numbers. We only receive a notification once your payment has been successfully completed. You can find more information in our Privacy Policy.

If a payment fails or is refused by the payment provider, we are not obliged to fulfil the order and will inform you by email.

Retention of Ownership

The products you order remain our property until we have received full payment of the purchase price.

Delivery of Goods

We currently deliver to addresses in Germany only. Depending on where an item is in stock, your order is sent from Germany or France. This does not affect your rights in any way, and there are no customs fees or additional duties.

You can choose between two shipping options at checkout:

Free Standard Shipping

Free of charge. Delivery usually takes 4 to 5 business days.

Insured Express Shipping

4.95 EUR. Delivery usually takes 2 to 3 business days. Your parcel is insured for its full value while in transit.

Delivery times start on the day after your payment has been received. Business days are Monday to Friday, excluding public holidays. Goods are delivered to the address you provide and in the manner shown in your order summary.

When your parcel arrives, please check its contents and let us know about any problems as soon as possible using the contact details in this document. You may refuse to accept a parcel if it is visibly damaged. This does not affect your statutory rights.

If an ordered item is unexpectedly unavailable, we will inform you without delay and refund any payment you have already made for that item.

Failed Delivery

We are not responsible for delivery errors caused by incorrect or incomplete address details provided during checkout.

If your parcel cannot be delivered or is not collected within the time allowed by the carrier, it will be returned to us. We will then contact you to arrange a second delivery attempt or agree on how to proceed. Unless agreed otherwise, the shipping costs for a second delivery attempt are borne by you, provided the failed delivery was your responsibility.

Termination for Cause

We reserve the right to terminate the contract with immediate effect for good cause, for example in the case of orders from public authorities, violations of the law or third party rights, or misuse of our shop. In particular, we may terminate the contract if you are a sanctioned person or entity or are located in a sanctioned territory designated by an authority that we are directly or indirectly subject to.

Any mandatory statutory rights of termination remain unaffected.

YOUR RIGHTS

Right of Withdrawal

The right of withdrawal applies to Consumers only. Business Users do not have a right of withdrawal.

Information on the Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period expires fourteen days after the day on which you, or a third party other than the carrier and designated by you, take physical possession of the goods.

If you order several goods together and they are delivered separately, or if a single item is delivered in several parts, the withdrawal period expires fourteen days after the day on which you, or a third party other than the carrier and designated by you, take physical possession of the last good or part.

How to Withdraw

To exercise your right of withdrawal, you must inform us (SOXI UG (haftungsbeschränkt), Spitzwegwinkel 7, 94315 Straubing, Germany, email: hey@havornelix.com, phone: +4915511521547) of your decision to withdraw from this contract by an unequivocal statement, for example a letter sent by post or an email. You may use the model withdrawal form in the Definitions section at the end of this document, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your notice of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including the costs of delivery, without undue delay and no later than fourteen days from the day on which we are informed about your decision to withdraw. Any additional costs resulting from your choice of a delivery method other than the least expensive type of standard delivery offered by us will not be reimbursed. As our standard shipping is free, this means the 4.95 EUR for Insured Express Shipping is not refunded.

We will use the same means of payment that you used for the original transaction, unless you have expressly agreed otherwise. You will not be charged any fees for the reimbursement.

We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent them back, whichever is earlier.

Returning the Goods

You must send back the goods or hand them over to us without undue delay and in any event no later than fourteen days from the day on which you informed us of your withdrawal. The deadline is met if you send back the goods before the period of fourteen days has expired. Please contact us at hey@havornelix.com before sending your return so we can give you the correct return address.

You will have to bear the direct costs of returning the goods.

You are only liable for any loss in value of the goods resulting from handling them in a way that is not necessary to establish their nature, characteristics and functioning.

End of the Information on the Right of Withdrawal

Exclusions

The right of withdrawal does not apply to goods made to your specifications or clearly personalised to your needs, or to sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

Returns in Practice

To help us process your return quickly, please send items back unworn, unwashed and with all original tags and packaging where possible. This is not a condition for exercising your right of withdrawal, but it allows us to handle your refund faster.

GUARANTEES

Statutory Guarantee of Conformity

All products sold in our shop are covered by the statutory guarantee of conformity. For new goods, this guarantee applies for two years from delivery.

If you receive an item that is faulty or not as described, please contact us at hey@havornelix.com with your order number and, if possible, a photo of the issue. We will take care of it in accordance with the statutory provisions.

Normal wear and tear, as well as damage caused by improper use or not following the care instructions on the label, does not count as a defect.

Money Back Guarantee

In addition to your statutory rights, we offer a voluntary money back guarantee. If you are not happy with your purchase, you can cancel it and receive a refund within 15 days from the day your order was delivered.

To use the money back guarantee, simply send us a clear message by email to hey@havornelix.com. You do not have to give a reason, but we would be grateful if you told us why you were not satisfied, as it helps us improve.

Within the same 15 days, you must also send the goods back to us at your own expense. Please make sure the items are undamaged, clean and fit for resale, and return them in their original packaging.

Once we receive the goods and have checked that these conditions are met, we will refund the purchase price using the same payment method you used for your order.

This money back guarantee does not limit your statutory right of withdrawal or your statutory guarantee rights in any way. If an item is faulty, you can always claim a free remedy under the statutory provisions.

LIABILITY

We are fully liable for damage caused intentionally or through gross negligence by us, our legal representatives or our vicarious agents, for damage resulting from injury to life, body or health, and under the German Product Liability Act.

In cases of slight negligence, we are only liable for the breach of essential contractual obligations. These are obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely. In such cases, our liability is limited to the typical damage that could be foreseen when the contract was concluded.

Within these limits, we are not liable for damage caused by interruptions or malfunctions of our shop due to events beyond our control, such as force majeure, failures of telecommunications or power networks, strikes, natural disasters, viruses or cyber attacks.

Apart from the cases above, our liability is excluded.

Indemnification

If a third party makes a claim against us because you culpably violated these Terms, third party rights or statutory provisions while using our shop, you agree to indemnify us against such claims, including reasonable legal costs, to the extent permitted by law.

COMMON PROVISIONS

No Waiver

If we do not enforce a right or provision under these Terms, this does not mean that we waive that right or provision.

Service Interruption

To keep our shop running smoothly, we may interrupt it temporarily for maintenance, system updates or other changes, and will inform you appropriately where possible. Within the limits of the law, we may also decide to suspend or discontinue the shop altogether. Orders already placed will still be handled in accordance with these Terms.

Reselling

You may not reproduce, copy, sell, resell or exploit any part of our shop without our express prior written permission.

Intellectual Property

All intellectual property rights relating to our shop, including copyrights, trademark rights and design rights, belong exclusively to us or our licensors and are protected by applicable law.

All trademarks, trade names, logos, illustrations and images appearing in connection with Havornelix remain the exclusive property of us or our licensors.

Changes to These Terms

We may update these Terms from time to time, for example when the law changes. The version in force at the time you place your order always applies to that order. Changes only take effect for future orders. Previous versions are available from us on request.

Assignment of Contract

We may transfer our rights and obligations under these Terms to another party, taking your legitimate interests into account. You may not transfer your rights or obligations under these Terms without our written permission. Your right to assign monetary claims under statutory provisions remains unaffected.

Severability

If any provision of these Terms is or becomes invalid or unenforceable, the remaining provisions remain fully valid. The invalid provision will be replaced by the applicable statutory provisions.

Governing Law

These Terms and all contracts concluded under them are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods.

If you are a Consumer, this choice of law only applies as far as it does not remove the protection given to you by the mandatory consumer protection laws of the country where you habitually reside.

Place of Jurisdiction

If you are a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from these Terms is Straubing. For Consumers, the statutory rules on jurisdiction apply.

ACCESSIBILITY

We want our shop to be easy to use for everyone. If you have a disability and are unable to access any part of our shop, please let us know with a description of the issue. If the issue can be identified and solved with standard technical tools and methods, we will address it as quickly as possible.

DISPUTE RESOLUTION

Amicable Dispute Resolution

If you have a complaint or a disagreement with us, please contact us first. We will always try to find a fair solution together with you. Your right to take legal action remains unaffected.

Please send your complaint by email to hey@havornelix.com with a short description of the issue and, if applicable, your order number. We will handle your complaint without undue delay.

Consumer Arbitration

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
